When renting a Farte Bysykkel, we process personal data about you. Here you will find information about what personal data is collected, for what purposes it is used, and about your rights regarding the processing of your personal data.

Telemark County Municipality (org. no.: 929 882 989), (hereinafter referred to as TFK), is responsible for the processing of personal data stored and processed in connection with the Farte Bysykkel service.

Purpose
Farte Bysykkel aims to provide customers with the opportunity to rent city bikes through the Farte Bysykkel app.
The purpose of data processing in various parts of the solution is to ensure that:
• you as a customer have access to city bikes when you need them
• the solution is not misused
• sufficient data about users is recorded so that users can be contacted in the event of damage, breach of contract, or theft
• sufficient usage statistics are collected to develop and improve the service
What We Process
When renting a city bike through the Farte Bysykkel app, the following information about you is processed:
• Name
• Phone number
• Email
• Address
• Rental history
• Location data related to bike usage
• Information about your contact with us
To pay for the city bike service by bank card, a payment service provider is used. Stripe is the payment solution provider, and detailed bank card information is stored only by Stripe.
What Personal Data We Process, Purpose, and Legal Basis
The basis for processing the data mentioned above is to provide the services to you and operate the services in the best possible way, including identifying you as a user, giving you access to bikes, and sending you notifications about usage time and communication in the app.
• To fulfil the agreement with you and provide access to the city bike service, we need information about who you are, and this is verified by checking your phone number.
• To manage the customer relationship, we need to process the personal data you provided when creating your user profile with us, including, among other things, responding to enquiries from you as a customer via our channels. We also need to check your activity in the Farte Bysykkel app to respond to enquiries about these services, for example in connection with troubleshooting.
• Your location is processed for the following purposes:
o You must grant location access in the Farte Bysykkel app to unlock a bike. The phone’s location is processed when the app is active to determine whether you are near a parking zone. Location data from your phone is not stored in our systems.
o To manage and operate the service, we need information about where the bike is located, which we obtain through GPS tracking of the bike. We may also use such location data for troubleshooting equipment and in connection with the execution of the rental agreement.
o The phone and bike locations are used to provide you with information about how far you are from a specific city bike.
o TFK also processes personal data such as the phone’s location to respond to requests you make from the app for travel searches. This is used, for example, to show you the route to a bike or a parking zone.
• In addition to the purposes described above, we process:
o The phone’s location during a trip, used to provide you with trip history on a map, improve positioning when ending a trip at a station, and provide a grouped overview of where other users cycle.
o Emails with information about the service if you have consented to this, e.g., changes to the service, operational messages, opening of new parking zones, and usage guidance and tips.
• User data is processed to comply with legal obligations that TFK is subject to or orders from public authorities, including accounting requirements.
• Personal data is processed to safeguard TFK’s rights, including establishing, exercising, or defending a legal claim in connection with lost or damaged city bikes, or to safeguard TFK’s legitimate interests, such as issuing warnings and suspensions for late return of bikes or other rights TFK has under the agreement with you.
• Trip history/sales documentation contained in your purchase may be retrieved as personal data in cases where it is necessary to review all details related to a specific purchase, for example, in the case of a complaint or other enquiries that require reviewing all details related to a specific purchase.
Access to Personal Data
Personal data processed will only be accessible to personnel with a customer-related need at the data controller and defined data processors under contract. All lookups/access performed will be logged with the time and the person who accessed the data.
Legal Basis
The legal basis for using your data mentioned above is that it is necessary to fulfil the agreement with you regarding the use of the city bike (cf. GDPR Article 6(1)(b)). To use the service, the terms of use must be accepted, and a valid phone number must be registered in the Farte Bysykkel app to verify the user’s identity.
For processing data related to handling damage cases, theft, etc., and statistics on the use of the services, the legal basis is that this is necessary for purposes related to the legitimate interests pursued by Telemark County Municipality, which is responsible for providing the service, in operating and improving the service (GDPR Article 6(1)(f)).
Your Rights
Access to your data is limited. You have the right to access, rectify, data portability, and delete the data stored about you. See https://telemarkfylke.no/no/personvern for more about your rights, contact information, and how to exercise your rights.
We do not resell personal data to third parties.
Storage and Deletion
TFK depends on having certain information about the user as a customer to offer the city bike service, and the consequence of not providing such information is that TFK cannot provide the city bike service to the user.
How long is the information stored?
• We do not store your personal data longer than necessary. This means, for example, that personal data processed based on your consent will be deleted if you withdraw your consent.
• Personal data we process to fulfil an agreement with you is deleted when the agreement is fulfilled and all obligations arising from the contractual relationship are met. For example, profile data is retained for as long as you are an active customer with us and deleted after 3 years of inactivity. Order history is deleted 3 years after the last purchase (rental), but accounting information is retained for 5 years in accordance with accounting law requirements.
• Location history data is anonymised, usually after three months, when full history is no longer needed.
You can delete your user profile at any time. You can do this via the “delete user” function in the app or by contacting our customer service for assistance.
If you delete your user profile, all related data and history will be deleted from the system’s servers within 30 days at the latest.
You cannot rent a city bike without an active user profile. It is not possible to delete a user profile during an ongoing rental.
In cases where there are unresolved issues related to your customer relationship, such as unpaid invoices or similar, it will not be possible to delete the user profile until the matter is resolved. Furthermore, TFK reserves the right to continue storing your personal data in cases where it is necessary to:
• establish, exercise, or defend a legal claim, including safeguarding Telemark County Municipality’s interests in a dispute with you regarding, for example, a lost or damaged bike.
• comply with legal requirements, including requirements for continued storage under accounting legislation.
