Term & Conditions Fjordsplorer AS
These terms and conditions constitute the agreement between Fjordsplorer AS and You.
- Create customer account and purchases
- To be able to use the services of Fjordsplorer AS, You accept that You need to register as a customer, by creating a user profile on the ShareBike app and fill out all requested information and add a valid payment card. You must ensure that all the needed information is accurate and current. You must also confirm that You agree to all terms and conditions listed in this agreement.
- Your account is personal, and You cannot share your user profile with others, nor transfer or resell a rental.
- You must be 18 years or older.
- Prices for use of the service can be found here.
- Use of the bicycle
- Trip length. You can rent for as long as you want.
- Your responsibility. You are responsible for the bike from the time You pick it up in a bike station and until You have returned it to a bike station. Do not leave the bike to others, or unattended. You are solely responsible if you injure yourself or others while using the bicycle. You accept that You rent and use Fjordsplorer AS products and services completely on your own risk.
- You warrant and agree that You are physically fit and possess reasonable competence to use and operate any of our bikes and services. You also warrant that You possess the necessary capabilities to make competent assessment of the driving conditions to be able to use our services in a responsible manner. This includes considering weather conditions, Your health status, and/or any other factors that may be relevant for operating an electric vehicle. You understand that You are solely responsible to adapt speed, breaking and general riding behavior to e.g. (but not limited to) traffic, road state, weather circumstances and similarly to ensure competent and responsible usage.
- You may not operate a bike while under the influence of any alcohol, drugs, medication, or other substance that may impair Your ability to safely operate a bike.
- Please walk Your bike, do not ride it, to and from the outer edge or perimeter of a station and the bike dock when taking or returning it.
- The bike is intended for use by one person only; You may not carry, tow, or otherwise transport a second person.
- The bikes are designed for usage on regular roads, and should not be used in forests or off regular roads.
- You must bike responsibly and comply with all traffic rules. You must also be aware of your surroundings and show consideration for other people on the road.
- You must return the bike in the same condition in which You rented it.
- You may not modify, dismantle, write on, or otherwise alter or deface a bike or any part of a bike in any way.
- You agree that, when using a bike or any of the services, You are responsible to take any safety measures and precautions to ensure safe and proper use of the bikes. It is not required by law to use a bike helmet in Norway, but Fjordsplorer AS strongly recommends that You use a bike helmet.
- Defect or damaged bike. The bikes are put out in good condition and are frequently controlled and maintained. However, it may still be possible to find a defective bike in the station. You are personally responsible to make sure that the bike is in proper condition before you use it, by doing a basic safety check on the bike. Fjordsplorer AS is not responsible for damage that occurs due to a defective bike that you intentionally or negligently use. Brakes must be checked immediately after the bike is taken out from the bike station.
- Notification of defect or damaged bike. You must immediately report and notify Fjordsplorer AS via the app if you discover major damage or defects on the bike. You warrant and agree that You shall not use the bike if this happens. If you report a defect bicycle and place it back in the bike station within 5 minutes of taking it out, the cost will be refunded.
- Locking the bike. If You leave the bike unattended during the rental period, e.g. if You are going to the store or visiting a tourist attraction, You need to make sure that the bike is securely locked with the integrated locking function.
- Lost bike. You must immediately report in the app if the bike is lost/stolen. If the bike is not properly locked, and/or it gets lost/stolen due to negligence, you will be held liable for any damages or costs related to it.
- End the trip
- Ending the rental period. At the end of the rental period, You must return the bike to the same bike station. The rental ends when the bike is properly and correctly placed in the station. You will receive confirmation in the app that the bike has been delivered and the rental has ended. Make sure that You do receive such confirmation, since You are responsible for the bike until successfully returning it. Fjordsplorer AS cannot be held accountable for any additional charges that may occur, or if the bike is stolen due to wrongfully returning/placing the bike in the station.
- Problems with termination. If you experience issues with terminating the rental as mentioned above, you must immediately notify Fjordsplorer AS in the app.
- Confirmation of the rental. If you have not terminated the rental correctly within 12 hours from the start of the rental period, You accept that Fjordsplorer AS can contact You at any time to check if You still wish to continue the rental.
- Fjordsplorer AS termination of the rental. Fjordsplorer AS may terminate the rental period at any time, if we have reason to believe that You no longer wish to rent even though the rental has not been terminated correctly, or we have reasonable grounds to believe that You do not take sufficient care of the bike. In such cases, Fjordsplorer AS may charge You a fee of up to NOK 2,500. That also applies if the bicycle must be picked up at a place other than a Fjordsplorer AS station.
- Liability, etc.
- If you lose or damage the bike, or it is stolen from you, because you have not complied with one of the terms above, Fjordsplorer AS can hold you liable for damages and costs, limited upwards to the bike's purchase price.
- Fjordsplorer AS is not responsible for personal and property damage that occurs due to a defective or damaged bicycle that You use if You should have discovered the damage at the start of the rental period. The same applies if You continue to use the bicycle after a defect or damage has occurred during the rental period.
- If You leave the bike unattended or outside one of the Fjordsplorer AS stations, You do so at Your own risk, and are liable if the bike gets stolen or damaged as a result.
- By entering into this agreement You accept and agree that all use of our products and services are solely at Your own risk and responsibility.
- You confirm and understand that electric bikes are electric vehicles that may experience issues or malfunctions, even if it has been properly maintained and inspected before use. Such issues may cause injury, damages or dangers of various sorts to You and/or others, people, property or similarly. You confirm that You understand and agree that You are solely responsible for all such dangers and risks that may occur from operating any of these vehicles. When choosing to use our services and operate any of our vehicles You confirm that You assume full responsibility for all related risks and dangers, and that You may be liable for all relating damages, deaths and/or costs.
- Privacy
- You accept that all bicycles are equipped with GPS tracking and that such tracking is a condition for using Fjordsplorer AS bikes and services.
- Fjordsplorer AS collects, stores and process various personal information about you. Fjordsplorer AS is responsible for processing this information. The details regarding this information can be found in Fjordsplorer AS Privacy Statement.
- You have the right to send a complaint about Fjordsplorer AS way of processing your information to the Norwegian Data Protection Authority.
- Fjordsplorer AS uses services from subcontractors to provide a bicycle rental system. These companies may access and process personal data, but only to the extent necessary for the performance of their service.
- You have the opportunity to access, correct, and delete the personal information that Fjordsplorer AS has about you in accordance with the requirements of the Personal Data Act. You also have the opportunity to have the personal information handed over to yourself or to a data controller of your choice.
- Force Majeure
- Fjordsplorer AS cannot be held liable if the following circumstances (but not limited to) prevent the bicycle service from being adequately delivered: Labor disputes, computer attacks, unplanned downtime on computer systems, destruction of infrastructure, theft, extreme weather, fire, war, natural disasters, terror and epidemics.
These terms and conditions are regulated by, and shall be interpreted in accordance with Norwegian law.
