Terms and Conditions for Gjøvik City Bikes
These terms for Gjøvik Municipality's city bikes constitute an agreement between Gjøvik Municipality and you.
Creating a Customer Account and Purchase
You are registering as a user of Gjøvik Municipality's city bikes and associated services provided by Gjøvik Municipality.
You may not share your user profile with others.
You must be over 16 years of age.
Prices for use of the service can be found at www.gjovik.kommune.no/bysykkel and in the app "Bysykkel Gjøvik".
Use of the Bicycle
You may rent for as long a period as you wish.
Your responsibility.
You are responsible for the bicycle from the moment you collect it from a rack until you have returned it to a rack. You must not hand the bicycle over to others. You are responsible if you cause injury to yourself or others while using the bicycle.
You must cycle considerately and comply with traffic regulations.
Defective or damaged?
The bicycles are put out in good condition and are continuously inspected and repaired. However, you may find a defective bicycle in a rack. You are therefore personally responsible for checking that the bicycle is in a satisfactory condition before use. The brakes must be checked immediately after the bicycle is taken out of the rack.
Reporting a defective or damaged bicycle.
You must immediately notify customer service via the app if you discover significant damage or faults with the bicycle.
Locking the bicycle.
If you leave the bicycle during the rental period — for example, if you go into a shop — you must ensure it is properly locked using the integrated locking function.
Lost bicycle.
You must immediately notify customer service via the app if the bicycle goes missing. If the bicycle is not properly locked when you leave it, you will be liable for compensation if the bicycle is stolen.
Ending the Trip Ending the rental period.
After the rental period, you must return the bicycle to one of Gjøvik Municipality's charging stations. The rental period ends when the bicycle has been correctly placed in the charging station. You will receive confirmation in the app that the bicycle has been returned and the rental period has ended.
Problems ending the rental.
If you have difficulty ending the rental in the manner described above, you must immediately notify Gjøvik Municipality via customer service in the app.
If you have not correctly ended the rental within 12 hours of the rental period starting, Gjøvik Municipality may contact you at any time to check whether you still wish to continue renting.
Gjøvik Municipality may terminate the rental.
Gjøvik municipality may at any time terminate the rental period and retrieve the bicycle if there is reason to believe you no longer wish to rent or you are not taking adequate care of the bicycle.
Liability
If you lose, have stolen, or damage the bicycle as a result of failing to comply with any of the rules above, Gjøvik Municipality may hold you liable for compensation, capped at the purchase price of the bicycle.
Gjøvik Municipality is not liable for personal injury or property damage arising from a defective or damaged bicycle that you use, if you should have noticed the issue at the start of the rental period. The same applies if you continue to use the bicycle after a defect or damage has occurred during the rental period.
Privacy
You acknowledge that all bicycles are equipped with GPS tracking, and agree that such tracking is a condition of using Gjøvik Municipality's city bikes.
Gjøvik Municipality collects, stores, and processes various personal data about you. Gjøvik Municipality is the data controller for this information. Details regarding the relevant data can be found in Gjøvik Municipality's privacy policy for the city bikes, available in the app and on our website.
You have the right to lodge a complaint about Gjøvik Municipality's processing of your data with the Norwegian Data Protection Authority (Datatilsynet).
When using services from third-party suppliers in connection with the services provided by Gjøvik Municipality, these companies may access and process personal data, but only to the extent necessary for the performance of the service. The identity of the relevant subcontractors and third parties can be found in our privacy policy.
Disclosure of personal data beyond what is necessary to provide the service, or beyond what you have explicitly consented to, will only occur to the extent permitted by data protection legislation.
You have the right to access, correct, and delete the personal data that Gjøvik Municipality holds about you, in accordance with the requirements of data protection legislation. You also have the right to have your personal data provided to yourself or to a data controller of your choice.
Force Majeure
Gjøvik Municipality cannot be held liable if the following circumstances prevent the bicycle service from being adequately delivered: labour disputes, cyberattacks, unplanned downtime of computer systems, destruction of infrastructure, theft, extreme weather, fire, war, natural disasters, terrorism, and epidemics.
