IMPORTANT: READ CAREFULLY BEFORE PROCEEDING
By unlocking and using a Weelz E-Bike via the Weelz mobile application (the “App”), I
(“Rider”) hereby acknowledge, understand, and agree to the following terms and conditions of
this legally binding Waiver and Release Agreement (“Agreement”), made in favor of Coleand
Holdings Ltd. (doing business as "Weelz"), its officers, directors, employees, agents,
representatives, partners, affiliates, successors, assigns, and the owners or operators of any
properties on which Weelz E-Bike stations are located (collectively, the “Released Parties”):
1. Voluntary Participation & Assumption of Risk
I hereby acknowledge that:
• I am voluntarily renting and operating a Weelz E-Bike.
• I am at least 18 years of age, of sound mind, and legally competent to enter this
agreement.
• I am physically and mentally capable of operating an electric bicycle.
• I understand that operating an electric bicycle carries inherent risks, including but not
limited to collisions, falls, mechanical failure, road hazards, inclement weather, negligent
acts by others, and other unforeseen risks that may result in injury, disability, death, or
property damage.
I voluntarily assume all such risks, known or unknown, foreseeable or unforeseeable, associated
with the use of the Weelz E-Bike and associated equipment.
2. Helmets and Safety Equipment
I understand that each Weelz E-Bike is equipped with a permanently attached helmet, and:
• Helmet use is strongly recommended by Weelz;
• Failure to wear a helmet significantly increases my risk of serious injury or death in
the event of an accident;
• It is my responsibility to wear the helmet correctly and ensure it is properly secured
before riding.
3. Use of Instructions and Signage
I acknowledge that:
• Safety and operational instructions are clearly provided within the Weelz App at the
time of rental;
• Safety signage is also posted at all physical Weelz E-Bike station locations;
• It is my responsibility to review and comply with all such instructions and posted
rules before using the E-Bike.
4. Compliance with Laws
I agree to:
• Obey all local traffic laws, road signs, and regulations applicable in The Bahamas;
• Refrain from operating the E-Bike under the influence of alcohol, drugs, or any
substance that may impair my judgment;
• Not ride with any passengers, perform stunts, or use the E-Bike in a reckless or unsafe
manner;
• Not tamper with or modify the E-Bike, locking system, helmet, or station infrastructure.
5. Waiver, Release & Indemnification
To the fullest extent permitted by Bahamian law, I hereby:
• WAIVE AND RELEASE the Released Parties from any and all liability, claims,
demands, actions, causes of action, or losses of any kind, whether in law or equity,
arising out of or related to any injury, death, property damage, theft, or loss incurred
while using the Weelz E-Bike and related services, regardless of cause;
• HOLD HARMLESS AND INDEMNIFY the Released Parties from any claims,
including legal fees and costs, brought by third parties due to my actions or omissions
while using the E-Bike;
• Agree that this waiver applies even if the loss or injury is caused by negligence,
whether passive or active, on the part of the Released Parties.
6. Damage, Loss & Fees
I agree to:
• Be responsible for any loss, theft, or damage to the E-Bike and attached helmet caused
by my actions or failure to follow instructions;
• Promptly report any accidents or mechanical issues through the Weelz App;
• Authorize Weelz to charge my account for any repair, replacement, or related fees as
outlined in the App.
7. Acknowledgment of Binding Nature
I acknowledge and agree that:
• This Agreement shall be binding upon me, my heirs, next of kin, executors,
administrators, and assigns;
• This Agreement shall be governed by and construed under the laws of the
Commonwealth of The Bahamas;
• If any provision is found to be invalid, the remaining provisions shall remain in full force
and effect;
• This Agreement contains the entire understanding between the parties regarding the
subject matter herein and supersedes any prior understandings or representations.
8. Electronic Signature & Consent
By proceeding with the rental through the Weelz App, I hereby acknowledge that:
• I have read, understood, and voluntarily agreed to this Waiver and Release in its
entirety;
• I am providing my electronic consent and signature, which is legally binding under
Bahamian law and has the same force and effect as a physical signature.
